Privacy Policy

This Privacy Policy describes how York Barbell Co. Ltd. (”York Barbell”, “we”, “us”, or “our”) collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from www.yorkbarbell.ca (the “Site”) owned and operated by York Barbell Co. Ltd.; or otherwise communicate with us (collectively, the “Services”). For purposes of this Privacy Policy, “you” and “your” means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

Create an Account: You do not have to create an account to visit or use our Site, including when you make an online purchase. However, to access certain services on our Site, you may be required to create an account and provide personal information such as your name, email address, mailing address, phone number, company name (if applicable), as a username and password that you create, and security questions. We use this information to create and administer your online account. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages). If you become aware of any unauthorized access to or use of your account, you are required to notify us immediately.

Search for a Product/Location: With your consent, we may collect information about your location when you use one of our location-based services on our Site, such as to find a product or retail location near you and to surface relevant marketing offers. You may limit our access to your location information by adjusting the permissions on your web browser.

Providing Products and Services: We use information provided by you to fulfill any orders placed through the Site, including processing your payment, processing your order, to send notifications to you about your account, purchases, returns, exchanges or other transactions, to create or manage your account, arrange for shipping, and any returns or exchanges and to enable you to post reviews.

Purchase/Order Information: When you purchase a product through our Site, we (or our authorized third-party payment processor) may collect information such as your first and last name, company name (if applicable), email address, phone number, billing and shipping address, and payment information (including your billing address and credit card information) in order to process the transaction and deliver your order.

Request a Quote: When you request a quote through our Site, we may collect information such as your first and last name, company name (if applicable), email address, phone number, and shopping information including the items you view and put in your cart.

Screen Our Orders for Potential Risks or Fraud Prevention: We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe.

Marketing and Advertising: We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. If you sign-up to receive email marketing communications, we may collect your first and last name, province/postal code and email address to send you newsletters, offers, promotions, and updates. This may include using your personal information to better tailor the Services and advertising on our Site and other websites. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Alternatively, you can opt-out of receiving email marketing communications by contacting us at the contact information provided in the “Contact Us” section below. Please note that you may continue to receive transactional or account-related communications from us.

Contests and Promotions:  If you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required to administer your participation in the contest or promotion, including to deliver a prize to you.

Surveys: From time to time, we may offer you the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, de-identified form. We use this information to help us understand our users and to enhance our Site as well as our products and services.

Contact Us: We use your personal information to provide you with customer support and improve our Services, including the information you choose to include in communications with us, for example, when sending a message through the Services. When you contact us with a comment, question or complaint, you may be asked for information that identifies you, such as your first and last name, company name (if applicable), email address, telephone number, along with additional information we need to help us promptly answer your question or respond to your comment. We share information with third parties to provide you with better Services and to help us achieve any of the uses describe above.

  • Affiliates:  With your consent, we may share and analyze personal information across our affiliates and brands in order to better understand and tailor communications to our customers, and help us create products, new services and experiences.   • Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of York Barbell or as part of a corporate reorganization or other change in corporate control.

We do not use or disclose sensitive personal information for the purposes of inferring characteristics about you.

We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. HOW WE PROTECT YOUR PERSONAL INFORMATION

While we take all reasonable precautions to ensure that user information is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore, we are unable to guarantee the security of user information beyond what is reasonably practical.

We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements.


YOUR GDPR RIGHTS

Under the GDPR, you have the right to be informed, access, rectification, erasure, restrict processing, data portability and to object. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.


CHILDREN

We do not knowingly collect any personal information about children under 14 years of age. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. Or if we learn that we have collected personal information from a child under 14 years of age, the personal information will be deleted as soon as possible.

We do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 14 years of age.


HOW TO ACCESS, MODIFY OR DELETE PERSONAL INFORMATION

Subject to applicable law, you have the right to access, update and correct inaccuracies in your personal information in our custody or control. If you would like to know if we have collected your personal information, would like to access your information, or if you would like your information to be deleted or modified in any way, please email or write to us at the “Contact Information” set out below. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records.


HOW LONG WE STORE PERSONAL INFROMATION

User information will be stored only until the purpose the personal information was collected for has been achieved, or as otherwise required to meet legal or business requirements.

You will be notified if your personal information is kept for longer than 12 months.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.


CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the “Last updated” date and take any other steps required by applicable law. INFORMATION ABOUT OUR PRIVACY GOVERNANCE POLICIES AND PRACTICES

We are committed to protecting personal information and have implemented a comprehensive set of policies and practices that govern our treatment of personal information. These policies and procedures include, among other things, the following:

  • We have implemented policies and procedures to protect personal information in our custody and control from unauthorized access, use or disclosure.
  • We have implemented processes to respond to data subject requests and complaints in a timely and effective manner.
  • As set out above, we have implemented a framework for the retention and destruction of personal information to ensure compliance with legal obligations, and to securely destroy personal information once no longer required.
  • We have designated a Privacy Officer who is responsible for overseeing the York Barbell’s compliance with privacy legislation.
  • We have implemented a privacy framework that defines the roles and responsibilities for our employees with respect to the treatment of personal information.

We provide our employees with regular privacy training and awareness.
